Terms of Service

1. Services

FlexPayout provides managed freelance operations services, including talent sourcing coordination, onboarding workflows, employment/compliance documentation where applicable, payroll processing, payslip generation, and payout delivery (wallet/virtual card and/or bank) to eligible recipients.

2. Eligibility & Availability

Services are provided subject to onboarding approval, compliance checks, jurisdiction coverage, local regulations, and issuer/network availability. Card features and availability vary by country and may change based on regulatory or issuer requirements.

3. Company Responsibilities

Companies confirm they are authorized to submit payment requests, provide accurate information, and pay invoices in full (gross + FlexPayout fees). Companies confirm payments relate to lawful services and lawful sources of funds.

4. Worker Responsibilities

Workers must provide accurate information and documentation and respond promptly to compliance requests. Workers must accept applicable employment documents and issuer program terms/disclosures presented during onboarding.

5. Fees & Billing

  • Company billing: FlexPayout invoices companies for a single amount covering gross compensation + FlexPayout fees. Company pricing may be presented as “starting from” and may include a success fee when a candidate is hired/activated, as specified in the applicable order form/statement of work.
  • Worker membership fee: Workers may be charged a wallet + card membership fee of €4.95 / $4.95 per month, billed in the wallet currency, only for months in which at least one payroll payout is delivered through FlexPayout. This fee covers wallet maintenance, virtual card access, statements, notifications, and support.
  • Additional fees: FX and ATM/cash access fees may apply depending on currency, corridor availability, local regulations, and issuer/network rules. Applicable fees and limits are disclosed during onboarding and/or at time of use.

6. Compliance & Risk Controls

FlexPayout may suspend, delay, or refuse service where required by law, sanctions, AML, fraud prevention, or issuer policies, including where information is incomplete or inconsistent.

7. Disclaimers

Coverage and timelines are not guaranteed. Processing times depend on checks, payment methods, and network availability.

8. Limitation of Liability

Standard limitations and exclusions apply. Indirect or consequential damages are excluded to the extent permitted by law.

9. Governing Law & Contracting Entity

The contracting FlexPayout entity and governing law may vary based on customer location and will be specified in the applicable agreement/order.
